Description of Service Mercurie.ai is a health platform designed to help care providers achieve higher productivity through a scribe for generating medical records and natural language queries on medical records.
Healthcare Provider Profiles While we strive to maintain the quality of information on our platform, we do not verify or validate healthcare provider profiles. Users are responsible for independently verifying the authenticity and credentials of healthcare providers by directly communicating with them or their institutions. Mercurie.ai makes no representations or warranties regarding the accuracy, completeness, or reliability of provider profiles.
User Responsibilities You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.
Content You retain all rights to any content you submit, post or display on or through the Service. By submitting, posting or displaying content, you grant Mercurie.ai a worldwide, non-exclusive, royalty-free license to use, process, and analyze the content solely for the purpose of providing and improving the Service.

The software, technology, algorithms, and methods used to provide the Service, including but not limited to our medical record generation and natural language query systems, are proprietary to QuickSpring Health Private Limited.

However, please note that we currently do not have a HIPAA business associate agreement with these providers.
Profile and Record Visibility:
For personal users, profile details are only visible to their designated healthcare providers and trusted contacts.
For healthcare providers, certain profile information (including name, professional details, and country) is publicly visible to facilitate patient access. However, private information such as login email addresses remains confidential.
Medical records uploaded by users are only accessible to healthcare providers and trusted contacts after the user has explicitly granted sharing permissions for specific records.
Medical notes created by healthcare providers are only accessible to patients after the provider has explicitly shared them.
Account Retention and Data Management
We maintain inactive accounts indefinitely to preserve important medical documents unless explicitly requested for deletion by the user. This policy ensures that valuable medical information remains accessible when needed.
Users can view and download their medical records at any time through their account dashboard.
Users maintain full control over their uploaded documents and can manage sharing permissions as follows:
For user-uploaded documents: Users can grant or revoke access to healthcare providers and trusted contacts at any time.
For provider-generated documents: Once shared with patients, both the provider and patient maintain their own copy. Deletion by either party only removes their respective copy.
Consent for Data Processing By using our Service, you explicitly consent to:
The storage and processing of your medical records and personal information as described in this Privacy Policy;
The use of artificial intelligence and machine learning technologies to process and analyze medical records for the purpose of providing our services;
The sharing of your information with authorized healthcare providers and trusted contacts according to your sharing preferences;

You may withdraw your consent at any time by deleting your account, though this will not affect the lawfulness of processing based on consent before its withdrawal.

While we strive to ensure reliable delivery of notifications, technical limitations may occasionally prevent successful delivery.
Users are advised to regularly check their account dashboard for updates, especially when expecting medical notes from healthcare providers.
The absence of a notification does not indicate the absence of shared medical notes or important updates.
Security Breach Notifications In the event of a security breach that may affect your personal information or medical records:
We will make reasonable efforts to notify affected users via email about the nature and extent of the breach;
We will provide information about steps taken to address the breach and recommendations for user actions;
While we strive to provide timely notifications, users acknowledge that there may be delays in breach detection and notification;

Data Portability
Users have the right to access and download their medical records at any time through their account dashboard;
Downloaded records will be provided in commonly used electronic formats;
Users are responsible for securing any downloaded medical records and personal information;
The ability to download records may be temporarily limited if there are technical issues or maintenance activities.
Data Deletion You can delete your records at any time by clicking the delete button on the record's page. This will completely erase the record from our platform. For records uploaded by healthcare providers and shared with patients, a copy of the record is held by the provider and the patient each, and the record is deleted from our platform when they both have deleted their copies.
Data Protection Rights Under Indian data protection laws, you have certain rights regarding your personal data, including:
the right to access your personal data;
the right to correct inaccurate data;
the right to request deletion of your data;
the right to withdraw consent for data processing;
